Dear Lawyer,
I had filed I 485 in EB3 category in July 2007 and my priority date is November 2006. I want to start the process under EB2 category also. My organization is very big and will not bend any rules to accomodate anything. There is a job posted in my organization with the following requirements -
Required Qualifications
A Bachelor's degree or equivalent training in Business Administration, Health Service Administration, Mathematics, Project Management or Industrial Engineering.
Five or more years of progressive experience in an exempt-level business analyst, project management or process improvement role.

My question to you is whether this job requirement classify this job in EB 2 category? Thanks.

I am going on an international travel on job for 1 month during my OPT period. My OPT started in Jul 3rd 07 and I am planning to travel in the month of jan 08.

What are the documents that I need to procure for making my trip possible. Also, if someone could comapare this situation with international travel in H1 status it will be great help.

I had FP done way back in October 07..but there is no status change LUD on I-485..what to do??.:confused:..Do I take an appointment to talk to an officer or simply call USCIS ..

Guys,

I feel that I am in serious trouble.

I am an employee of a company which was recently raided by uscis. My 6th h1 expires April 2009 and we applied for 7th year h1 extension based on
the approved labor (labor filed in March 2008).

I am not sure at this stage, that my h1 will get approved since the company is under the scanner.(I checked the LCA and It shows the work location where I am working and not from IOWA which is good)

So..what are my options now

1) Can any other employer file for extension based on this company's approved labor?.

2) If I join the other company, what documents do I need to show to USCIS that the labor is approved from my old company(the company under scanner)?


Please let me know..what you guys think...Any help will be greatly appreciated

Hi - I am currently on an L1 blanket visa and it looks like my company will sell the unit I work for in the US. The parent company will sell the US division - I am currently in the process of applying for my GC - with the I40, and I485 both pending. I had my biometrics done today.

Want to gain some views on what my options are if the GC route does not pan out. I am on a UK passport, and would like to remain in the states. The GC is an employment based application - which is apparently quick, but I want to have a plan B. Is the next best option the H1B, and if so, will I be able to apply for this (if needs be) inside the US with another company if they are prepared to take me on?

Do not do this - please stop playing around with USCIS rules. There are sometimes unfortunate circumstances where folks lose status (e.g., OPT -> H1b) or are kept in dark about their H1B status by employers but for folks who break the law in a way that you are suggesting, I believe they should be punished.
