Fact Sheet: USCIS Offers Premium Processing Service for Certain Form I-140 Petitions Starting June 16, 2008
U.S. Citizenship and Immigration Services (USCIS) will make available Premium Processing Service for designated Form I-140 petitions1 (Immigrant Petition for Alien Worker) filed for alien workers in H-1B nonimmigrant status who are reaching the end of their sixth year in H-1B nonimmigrant status. Starting on June 16, 2008, USCIS will begin accepting Form I-907, Request for Premium Processing Service, for Forms I-140 filed for alien beneficiaries who, as of the date of filing the Form I-907:
* Are currently in H-1B nonimmigrant status;
* Will reach the end of their 6th year of their H-1B nonimmigrant stay in 60 days;

I think you need to reapply for H1 again (unless you are transferring your visa category to H4).

I am...but most of you ain't, so I figured that it made more sense to use an image you'd be more familiar with.

my i-485 status online says- On December 3, 2007 we mailed the document to the address we have on file. You should receive the new document within 30 days.
my priority date is not current.

Is core group out of mind...Sueing will waste our funds..
Please use this money for constructive tasks.
Since first day, if u have tried to make I485 filing w/o priority date current..
At least 90% of people wud have utilized AC21 and change employers.
Ofcourse you always convince the higher authorities, to let us file 485s and issue GC, when dates become current.
As long as we file 485 and utilize AC21, we will be in safe situation.
Have some plan and result oriented plan.
Thinking big is ok, but we shd know what actually we can do.

Hi
My wife is on h1.Her staffing company did not have a project from july 1st.
I applied for her h4 cos on july 7th.
Her company had applied for h1 amendment for change of location in may.status shows pending.
My question- are we safe in applying for h4cos on the basis of old approved h1.does the outcome of amendment h1 even matter, since there is no project anyhow and the person has applied for h4.

You can re-apply via the new employer without stamping. I have done that myself.

My brother is working for company X.
They have recently got one labor cert approval. The ads are 3 months old which they used for one employee who is working in exactly his skillset and responsibility.
He is planning to ask the company to do one GC for him in same category.
1. Can they use the same ads for him also.
2. If they can use, then what amount of time will it save for him.
3. What are the different things one has to do, before filing labor like wage determination, with specific employee, and how much time each thing take. Are these tied to any specific employee, or can they be used for others also.
4. Somebody told me if valid ads are there, then it can save him 2-3 months, is it true.

My I-94 and L1A visa expired on October of 2008. I received my I-797A notice of action and my extended I-94, which is valid until June of 2010. My HR manager said I should be ok as long as I don't leave the USA.
I need to travel outside of the United States for one week. Will I be able to re-enter the USA if I show the approved Petition I-129 with the new I-94 and the expired visa?
Or will I need to go to the consulate to get a new visa stamp extended to June 2010 to re-enter the USA?
I will appreciate your help.

I had my tests done on Monday, X-Ray on Wednesday and my paperwork is ready today (Friday). All in all, it took about a week. Don't know about other doctors....this is in Milwaukee, WI.

I want to consult an employment/labor lawyer with regards to an employment agreement that I have signed with a desi consulting company in US. They have sponsored an H1b for me which I am yet to get stamped. I am in India right now and wanted to talk to a Labor lawyer who could tell me the effects of not joining this employer given that there are certain terms and conditions stated in the agreement. Could you suggest me some law firm in US where one can speak to a lawyer on the phone for a reasonable amount of money and seek legal advice.

I was under the impression that they send only one notice for each case and that too to the attorney.My attorney has send me a mail that he received the receipt notices and the original would have been sent to the employer.In case the employer has not received,he will send me a copy.
Do i need to have the original receipts.I have a valid L1 stamping and planning to travel early next month.I heard that i need to have atleast receipt notices if i dont have the AP approval by then.

I have a situation here.
I am on H1B visa and just changed my job in September.
My H1B transfer (thru my new company) was approved and according to USCIS website, they have dispatched my 797-Notice of Action. But I am yet to receive those papers.
Now, I was on extension of H1B earlier (thru my old company), as my stamped visa expired.
Now, my spouse needs to visit India urgently. Can she travel to India with her old I-94 (the one that was stapled on the passport when she entered US the last time) and the other I-94 that she has with the visa extension papers ?? Of course, once we get the new Form 797, I shall also travel to India and we both will get our visa stamping done before we travel back to USA. Please suggest...

I was laid off in early April, and the employer told me that they would revoke my H1B 30 days later (early May).
Now finally I get a job offer. The new employer can start to work on my h1b now, but the starting date will be late July.
I have an EAD right now based on my approved 140 and pending 485 (>=180days)
I talked with my attorney, and he said I would definitely have to go back to re-activate my H1B abroad, so I should use EAD instead of doing H1B.
Is it true that I have to go abroad to re-activate my h1B? I saw some people transferred sucessfully
Any thoughts? Thank you very much.

i recently got H1 Extension stamping ( Till 2011 ) and also have AP Expires in Nov 2008 .
I am working on H1 and not interested to use EAD .Do i still need to renew my EAD and AP?

just a tip not cool to hijack someone else' thread. on your question: If you are planning on being with the H1 sponsoring employer for the next few years no point renewing your EAD or AP. However they are two seperate filings. You don't need to have a valid EAD in order to apply for an AP renewal or vice versa. Hope this helps.
