Should be pretty straight forward. Ask her to take the signed I-20, financial support docs, letter from the department, and also from advisor (if possible). Though in our case, the VO didnt ask for a single doc but its good to have them all.

It was time, Mr. Reid said, to pay tribute to American soldiers in Iraq as their death toll reached 3,500.
A short time earlier, Mr. Reid convened a conference call with liberal bloggers, offering assurances that Democrats would revive debate over the Iraq war. And he pledged to revive it soon, ending the silence that followed the White House�s outmaneuvering of Democrats last month to win more money for the war without a timeline to end it.
�They�ve been driving this debate very well,� Mr. Reid said later, speaking of the bloggers who have been pushing for Congress to end the war. �I understand their disappointment. We raised the bar too high.�
It has been nearly three weeks since Democrats have held a formal Iraq debate or voted on an Iraq proposal in the House or Senate. Not since they assumed the majority in January has there been such a lull. During the three weeks, Congressional approval ratings have fallen, and Speaker Nancy Pelosi said she knew why.
�It�s the war, I believe so, it�s the war,� Ms. Pelosi said in a brief interview on Wednesday. �In terms of the issue that the American people want to have resolved, the war is three or four times higher than any other issue.�
Some Democrats argue that it is high time for the party to turn its attention to domestic issues � energy legislation, immigration overhaul and lobbying reform � to allay concerns that Democrats have not achieved enough significant accomplishments during the first six months of their majority. But other Democrats are demanding a return to the Iraq debate, which Mr. Reid has now pledged to do this month.
The proposals will not be new. Rather, Democrats intend to reprise at least four ideas when the Senate considers the Defense Department policy bill: a measure to reverse the authorization for the Iraq war, set a deadline for troop withdrawal, block money for major combat operations after March 31, 2008, and increase readiness requirements for troops to be sent back to Iraq. �On Iraq,� Mr. Reid said, �we�re going to hold the president�s feet to the fire.�
Democratic Congressional leaders have been stung by the decline in Congressional job approval ratings.
A Los Angeles Times/Bloomberg nationwide telephone poll released this week found that 27 percent of Americans approve of the way Congress is handling its job, while 65 percent disapprove. And 29 percent of the more than 1,100 poll respondents, all registered voters, said Democrats were working to change how government is run, compared to 63 percent who said Democrats are governing in a business-as-usual manner. The margin of error was plus or minus four percentage points.
Ms. Pelosi said it had been difficult to convince some Democrats that despite their majority, they are limited in how they can change the president�s Iraq policy.
�Some Democrats understand that we don�t have the signature and we can only do so much,� she said. �Others are just very unhappy. I include myself among them, being very unhappy that we have not been able to bring the war to an end.�
With September being highlighted as a critical review period for Iraq policy � Gen. David H. Petraeus, the top American commander, is to report to Congress on the progress of the current troop buildup � Democratic leaders had initially hoped to tackle their domestic priorities in late spring and early summer. But on Wednesday, Democratic leaders said they would not wait.
�The American people cannot and should not have to wait until later this year for changes in your flawed Iraq policy,� Ms. Pelosi and Mr. Reid wrote Wednesday in a letter to the White House.
Representative Rahm Emanuel of Illinois, the chairman of the Democratic conference, said Democrats could not be drawn into focusing solely on Iraq. �We have to do Iraq and change the priorities of Washington,� he said. �You can�t become a one-trick pony.�
The war has been the underlying theme of the new Democratic Congress, with barely a week going by without legislators embroiling themselves in committee hearings, a floor debate or symbolic resolutions for and against the war. Democrats have walked a careful line, trying to keep their criticism alive, but lowering expectations that they alone can influence war policy.
The month of June, though, has so far unfolded with barely a word being uttered about Iraq. And lawmakers said they were hearing about it.
Senator Amy Klobuchar, a Minnesota Democrat who was elected last fall, said constituents were seeking reassurance that Democratic efforts to challenge the administration have not fallen off. She said voters had little interest in being schooled in the intricate rules of the Senate, where 60 votes are required for debate to proceed on legislation.
�I share their frustration, answering them with procedural answers, �Well, we need 60 votes,� � she said. �People are dying over there, so that isn�t always helpful.�
While Congress must accomplish domestic priorities, she said, Iraq remains the chief issue for most voters. �I think that�s one of the things we�ve struggled with, is finding that balance,� she said, welcoming the news that the Senate intends to revive the debate before month�s end. �It�s very important to me. My current employer 'C' is in the process of filing Labor certification. I have to fill out Form # 9089 and give it back to my employer with past employment specifics.
I left my past employer 'A' on 9/23/2005, though was paid till 9/30. For the next month or so I was at home looking for a job on my own. When I did get successful I approached a consultant 'B' who filed for my H1-B transfer and offered me a appointment letter. We together kept looking for a job till 11/29 when I actually started working. When I got experience letter from these employers they told me that it is from the start of project date that you were on payroll. I am also sure that my employer 'A' did not inform the INS immediately but took about 15-20 days to send a letter after I had left.
My question is what dates should I put on the form, the actual dates or the ones I have on appointment letter

The H-1B system is clearly out-of-sync with the real world. Persons who qualify for �cap-subject� H-1Bs are allowed to apply starting April 1st each year, but can not start working until October 1st, six months later. Since the number of applications usually far exceeds the number of available visas, this means that by the second week of April, it is too late to apply. I am filing 1-140 and 1-485 together by myself based upn EB-2 ( national interest waiver ) category.
Would any one of you please tell me what I should check Part 2 where it ask " I am applying fr adjustment f permanent status based upon"-- If I choose 2(a), then it ask for copy of approval notice.
Any body has any comments.

USCIS is reporting that as of November 6th, 54,900 H-1Bs had been issued against the 65,000 annual quota. While this represents a dramatic drop in H-1B applications over previous years. In 2007, nearly 200,000 applications were filed in the first week applications were open and in 2009, the application period is now in its seventh month. Usage seems to be about 1,000 cases a week so we're probably looking at January or February to run out of numbers. Incidentally, yesterday I was the moderator of a panel on the impact of the global recession on national migration policies in Amsterdam....

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. On the other hand, Senator Lugar, his Republican counterpart from Indiana, is a much more likely vote in favor reform. Bayh may feel freer to vote...

My PD is 02/2004 EB2-India, and I will be current in June. However, as noted by multiple folks, there is a chance that EB2-India might retrogress during the rest of the fiscal year.
Have folks had luck with an InfoPass interview so push your case? I am afraid that without any encouragement my case will just languish on somebodys desk or in a box.

I had a question about using using AC21.
Here is the scenario: Let us say I work for XYZ Brothers who applied for my 140 and 485. I have approved 140, H-1b, EAD and AP.
If XYZ laid me off or I left them for career progression or more money 180 days after my 485 was filed and 140 approved what happens to my 485 application?
Wouldnt USCIS question that since my sponsoring employer does not exist anymore, who am I going to work for once I get my green card? or is this coverd under AC21?
Please advice!

IV Members,
My PERM Labor application was certified on Jan 24th 2011. Attorney received an email that the case has been certified and will send the approval notice shortly.
Its been close to 4 weeks and have not received the hard copy. can someone share their experiences about the time line to receive hard copy.

She will have to go out of country and get stamping for H4 if her spouse is maintaining H1.
Automatic validation does not happen..
I need help for my friend. My Friend's spouse on H4 started to work on EAD. She does not work (or if she gets laid off), will she automatically get her H4 status? If not, what does she need to do to get back on H4. Her husband is on H1.
