Hi,
I"m currently working for a TARP company and my I-94 date is Aug 2009. I still have 3 years left on my H1B.
I've got an offer from another bank (non-TARP) and they have filed for my H1 transfer.
a) Any idea what the wait times are these days?
b) Anybody seen problems with H1B transfers these days?
c) There might be a 1 week overlap (pay) between my current company and my future company. is that OK? e.g. My join date in the new company will be Feb 23rd and my notice date will be Feb 28th in my current company.

You are better off applying visa in a home country. Usually the have better access to verify records!

I have a green card. I have moved to India on 20 Aug 2007. Before going to India I had applied for my re-entry permit (I-131). The re-entry permit is valid from 31 Mar 2008 till 31 Mar 2010.
On 19 Aug 2009 I will be out of US for 2 years, so if I want to maintain my GC status before which date should I come to US and apply for re-entry permit, 20 Aug 2009 (the date of my US departure) or 31 Mar 2010 (expiration date of my travel document)?

Well, if you leave your co. now and also want your GC then:
Your H1 period will be over after 6 years irrespective of the I-140 from the old co.
GC: You do have to start from scratch.
However, you can still maintain your PD if your prev. co does not revoke the I-140. The documentation of your Old PD is to be attached with the New I-140.

Anyway, my guess is that native Americans must have been a lot more friendly to White people when they just came to this land. Hospitality is the nature of people in less advanced society. The more advanced a society is, the less hospitable the people are because people in more advanced society have a stronger sense of ownership.

Need help
I have approved labor for PD 2004 and I-140 got rejected in Dec'2006 due to education credential with 3 year degree. currently my I-290 is pending with AAO appeal for more than 10 months and my extension is based on that.
New labor is filed in June'2007 and got approved in September. I-140 is pending for the new labor.
My Current extension is getting expired in January 2008. If I get premium processed my extension on old case and if my appeal gets denied will my extension or my status gets invalid or I have valid extension upto next January to get other I-140 approval ?
Please let me know ASAP so I can request premium process for extension.

It wasn't immediately clear what impact the House move toward a simplified, less-controversial energy measure will have on the Senate version of the bill. The Senate is scheduled to debate auto-efficiency standards and a mandate for coal-based liquid fuels on the floor this week.
Rep. John D. Dingell (D., Mich.), chairman of the House committee, and Rick Boucher (D., Va.) chairman of the subcommittee that is preparing its energy legislation, jointly announced they will focus on less-divisive issues, including energy-efficiency standards for appliances, improvements to the nation's electricity grid and incentives for use of wind power.
"This procedure . . . was discussed with the speaker, and she understands the rationale for proceeding this way," the two Democrat leaders said, "so we can rapidly work on a bipartisan bill that can be signed into law."
The turnaround by Rep. Dingell, who has defended Detroit automakers against fuel-saving standards for years, comes as automakers have launched a nationwide lobbying campaign to water down proposed tougher auto-efficiency standards. Rep. Dingell promised to return to the issue in the fall, when the committee is also planning legislation that would regulate carbon dioxide and other emissions that scientists say are accelerating global warming.
While the Senate appears to be pressing ahead, it could face filibuster threats on the auto-efficiency standards and several other items, requiring 60 votes to overcome, a margin that may not be attainable. "One of the questions being discussed is which body goes first with some of these things," a House aide said.
"We have decided to proceed with provisions that represent consensus," Messrs. Dingell and Boucher wrote. The energy subcommittee is scheduled to assemble its new version of the energy bill this week, and the House could debate the completed bill after the July 4 recess. Earlier, Speaker Pelosi (D., Calif.) had asked for an "Energy Independence" bill by July 4.
The House committee also deferred discussion of a low-carbon-fuel standard, similar to California's, which would mandate increasing use of ethanol and other fuels that result in lower CO2 emissions. Another postponed issue is a change in federal law that would block California from establishing its own CO2 emissions standards for vehicles.
The two committee leaders said they were postponing debate because the issues "are complex and difficult."
Democrats are deeply split, with representatives from auto-producing states fighting tougher emissions standards, and the California delegation and liberal factions pushing for them. Coal-state Democrats and environmentally inclined Democrats are on opposite sides over coal-to-liquid fuels, which would emphasize diesel and jet fuels made from coal, a fuel the U.S. has in abundance.

My spouse H4 extension was filed in Jan 2011 and I was under impression that receipt is with lawyer. But recently I came to know that it should come to my address, as of today we have not got receipt no. I am still waiting for H1 approval decision and know H1 receipt no.

hi,
I am unmarried son of citizens of usa and have my priority date current.I filed for I485 adjustment of status to permanent resident, which earlier got rejected,but then on refiling,I got a MSC receipt number saying next process is biometrics
My question is that as I am presently on student visa and my classes are starting from august 17th.Do I still need to maintain my student visa status and enroll in 12 minimum units,or is it ok If I don't enroll and just wait for my further case processing,and I won't be considered out of status as my I-485 adjustment of status is being processed?Is there still chance of my I-485 being denied(I don't have any criminal or any wrong record and maintained my status prior to filing my I-485 adjustment of status).Please guide whether to still enroll in 12 units and be on student visa or is it ok if I don't enroll as I no more want to pay high fees but,am worried about maintaining my status.

Hi ,
I Am planning to apply for my 10th Year H-1B Extension with the same employer.
My last H-1B was in 2007. I looked on doleta.gov The Prevailing Wage
in 2007 for the same job and same location as I am right now at
Level 3 was 57000.00, Now in 2010 it is 76000.
I talked to my Employer about this, he says he cannot raise my salary that much.
My Question is
1. When I applied for Foreign Labor Cert On-line does the
Prevailing Wage has to be most recent even in case of H-1B Extension ?
2. Is is ok If I go to Level-2 Instead of Level-3, will it considered as
change in Employment ?
3. The Prevailing Wage for 2008 for the same job and same location
as I am right now at is 66000. Should I Try to Apply for labor
cert referencing 2008 Prevailing Wage. ?
4. What are my options ?

May be good or bad, depending on how you look at it....we will then be at the mercy of PERM...
If the Labor Department determines that a foreign worker would not displace Americans, that worker should not be barred from entering the country due to an arbitrary quota
This should definitely be high on the agenda.....although its very doubtful if this can ever be implemented.

i entered the US on AP in Jan 2010, and at the time of entry, my I94 validity was set for
1 year (viz Jan 2011) - and the AP also noted "AoS" status on it.
(a) Is the validity of my I94 (and thus my legal stay) 1 year, or as i have read elsewhere,
if AoS is pending, then its valid till the AoS case is decided?
(b) If the validity is 1 year, what is the process for extending the I94 validity?

If the new bill gets approved when will it likely take affect? I just had my LC approved today and they are going to file I-140. Before the EB-3 retrogression for all nationalities i was told i-140 an i-485 could be filed at the same time. what impact does the new bill have on my situation?
