Yes, this can be done. The H-1 company needs to submit a new I-129 petition requesting a change of status for your brother. Alternatively, your brother can leave the US, apply for an H-1 visa and re-enter in H status.

Hi,
My PD is 2005 and my I-485 was denied on the ground of my birth certificate and I got more proof from where I was born and submitted to USCIS and it was accepted in August 2009 and since then it has been more than a year and there is no update in the online status update for my I-485 application.
Lot of my friends from Late 2005 and early 2006 got the GC's last couple of months. I have requested my Lawyer to make a AILA inquiry? What else can I do at this point?

I applied for green card via national interest waiver category, and I decided to obtain green card through consular processing. To be eligible to get the immigrant visa in my home country, I showed consulate an offer letter from a U.S. company.
My question is , do I really have to work on that job after I enter U.S. ? Because I am not very interested in that position. And I am thinking about studying for an MBA, instead of working.
I was given a temporary green card when I entered the custom. It usually takes 2 month to get the official green card. But if I reject that offer , would my green card be revoked ?

Can someone advise on the alternatives of marriage / DOB certificates for the I-485 phase? My wife and I don't have a marriage certificate--we do have an affidavit from India, though (we married 10 years ago in India). Likewise, we don't have our DOB certificates issued by the municipalities we were born in. Would school certificates/affidavits from our parents work? What would be the easiest / quickest substitutes?

My Wife is on H4/AOS.
Her H4 is going to expire in September and she is planning to travel soon.
She has AP and EAD but never used. I am on H1 and used AC21.
My questions are..
1) Can she go to home country and get her H4 stamped and return on H4?
2) Apply AP and return on AP?
3) Assume...If she returns on AP...and show valid EAD while entering at POE....
But by that time her H4 expires.... In this scenario...do we still need to apply H4 extension after entering US?
4) Who supposed to apply H4? Is it employer or H1 holder can also apply H4?

If we lose our job after having the I-485 pending for more than 8 months, I-140 approved, how much time do we have to find another job?
Do we have to immediately withdraw the petition after losing/quiting a job?

The advice i got is that you should be in a new job ( and notified USCIS about usage of AC21 ) before,
1. The I-485 is approved
2. Any RFE directed to the old employer

I came to US on L1(worked for 1 year) and then switched to F1 till getting my H1B on May 2005 (which is 2 years old). How many years(3 or 4) do I have left on H1? I mean will the 1 year L1 count towards the total six years allocated for H1B?

AFAIK L1 counts towards that 6. So if you have done 1 on L1, 2 on H1, then you have 3 more years left on H1

You are ok. As per the USCIS FAQ they would not penalize you on that and your appl. will get accepted if otherwise OK.
My attorney sent my I-485 at Nebraska center because my I-140 was pending at Nebraska but according to question # 38 on FAQ-3, it should have gone to TX based on June 22, 2007 direct filing directives. Should I file again at Texas center?

Hi all,
This is urgent, your response is appreciated. I am switching jobs and my new employer wants me to go to the UK for some training in a week for about 5 days. They are sending the H1-B transfer application in couple of days, so the transfer has not been done. The img. lawer said they will send the receipt notice to me in the UK and I could travel back with my previous H1-B visa from my previous employer. I am a citizen of India woking in the STEM field for the last 2 years. I am still working and my employment will last for about 1 more week.
QUESTIONS:
1. Please let me know you see any problems at immigration when coming back to the US?
2. Can the employer wait couple of more weeks before sending cancellation of my H1-B visa without paying me during that time?
3. If I take an unpaid leave durimg this time, will that help?

My wife's H1B got approved earlier this week through company A. Company B also made an offer last month but they are still working on the H1B visa issue with the attorney.
So, my question is if this company (B) files H1B now, then it should be a "transfer (not subject to quota)" or "new petition (subject to quota)"?
I think she is already on H1B as of today with COS effective immediately approval so any new employer can only apply for transfer and they don't need to ask for COS. We will not have pay-stubs to transfer as we are still to receive the I-797 copy and apply for SSN so that payroll can be run for her.
