Completely Agree with you. Rather have some process than none.People in the forum are talking a lot about visa recapture..
But how will this help if USCIS continues to disregard PDs utterly and just approve cases that they can lay their hands on....
Due to July 2 fiasco, pretty much everyone have filed I-485...Even those with 2007 PDs.
Say USCIS recaptures Visas, makes every category current and starts approving 2007 PD cases! Even worst, due to the every category 'C', may be 2008, 2009 (when it arrives) people start applying I-485 as well, and USCIS continues to consume all the visa numbers to to approve the cases of these lucky bas*$%^&ds (no offence!) with most recent PDs. How does this help you or me with older PDs waitin for years and years ! :(

I do believe that each person has the right to champion for whatever cause s/he believes in. But don't you think that instead of this class war we should fight the USCIS system and ensure FIFO. I believe if we have a transparent and smooth USCIS functioning then a lot of our problems will be solved. At least we will know where we stand without the uncertainty!!

I applied concurrently on July 2.
I applied LC in Oct 2000, it went out of the lawyer's office- i got the approval of LC on June 22 2007 from BEC.
What I am seeing now, is my case got transferred from Nebraska to CA and now transfeered back to Lincoln, what beats me is :
I filed on July 2 (as per my lawyer) and ours is one of the well known Bay area company in the planet. I saw that Reciept date is marked as 30 Aug, and ND as Sep 10. This is from a Transfer notice I got, I did not get any reciept date yet so far. I know at least 100 odd EB2 cases and plenty of eb 3 from 2001 time frame getting lc approvals. I know this for a fact as we share our data across amongst us... waiting in silence for ever !....
The sad part is that some applicants who missed the boat called BEC with PD of around June 2004 on EB3/India got approved in June end/July time frame. I did see this on some forums external to IV.
I think there may be candidates from 2001/2002/2003 who may have applied in June/July 07. But if the rumors of NSC processing RD wise (as seen on some forum posts outside IV), then it is unfair to these people, because there may be others who missed the BEC boat and are ahead of these folks coming out of BEC.

This was directed to people who were current. If you are from India, China, Mexico, Philippines, get used to waiting. Your backlog is due to numerical limits. And this won't change (the way I see it)

Lets revive the campaign to remove country limits.
It is hurting EB immigrants from India and China and still people are unwilling to make this an important issue. We have not seen any employer take this up as an issue. However if you see country cap being added to the amnesty bill, the entire lobby of these people will make noise and will not let this happen. So let us stop giving arguments like diversity etc to ourselves because that really is not an argument across the board. So if country cap is an important issue for Indians and Chinese, they need to lobby hard against it. This has not really happened. Instead we get caught up in action items for small things that the community really wants. Imagine if the country caps are removed, the dates will move much faster. There needs to be strong support from the community if country caps were to be removed in CIR next year.

Any comments on this dual intent option and how it will effect current 485/140 ? As this supposed to effect cases of 140 filed after 15 may 07 ? Or where does it state in bill the same? If thats the case then there is no point of employment based immi at all

Most of the June/July/Aug'07 fiasco filers H4's might have received EAD's and thus SSN#...so when 2007 filing tax returns (married filing jointly) will have their SSN# listed could be eligilble.. isn't it??

Yesterday I went to the Local INS office after making an infopass appointment. Requested the IO to expedite my AP he looked at current processing dates for Nebraska Center Aug 15 I applied on July 20 INS process date on receipt notice August 25. He told me they would start looking at my case soon. I mentioned to him I need it expedited he asked why I showed him a letter from employer that I needed to travel outside us he said its not life death emergency. I insisted that if i didn't go I would get fired lose my job, he wait let me check with manager after 20 minutes he came back and said his manager agrees to process as emergency. He took all my original supporting documents and told me he was going to fax them to Nebraska center and also email to them. I mentioned to him that I have to leave by Feb 11 again he went to his manager and he said thats the best I can do. He took my phone number. I have not heard for INS no LUD on my case yet. If i don't leave by feb 17 kiss my job good bye. Anything else you guys recommend i can do. I also faxed the Nebraska center a request expedite still haven't hear or seen anything. :(

that might be your attitude. some people have a different opinion and dont like to bend over when circumstances try to screw them. If you pay for something and get a lemon you might be ok with living with it and moving on, saying its non-refundable. Many others dont share that view. They'll fight for a replacement, a fix, some solution to the problem.
If all you can do is bend over, then move on, you are wasting your time on IV.

I don't know what to tell you guys.. I'm surprised to see how some people's thought process work.
I have no Idea what's wrong in requesting USCIS to release some data which would tell how many applications they received of which chargeability and in which EB categories’ This is the only information needed to stop predicting, everybody here can make almost exact estimate when they can expect their application Adjudicated. And also in the mean time they should provide us assurance that they will issue EADs and APs in less than 90 days. We are in a foreign country and we need to travel to our home countries, if we are stuck with 1 year approvals our file is always in process, how do you plan a trip ???
Death in the family is the only reason they recognize as urgency for travel.
We are Humans, we have family back in our home countries, marriage in the family or family visit is also urgent..
To ask this you don’t need citizen rights you are asking a public agency a service which they are supposed to provide and they are charging us to do that...

Also USCIS emloyees have vested interest in continuing the status quo. If everything is filed electronically, you would see layoffs in USCIS.
Also they have other issues to deal with. There is a rush of naturalization applications last year. Similarly when crop season comes, they tend to agricultural workers visas. In these cases, staff is diverted from one paper mount to other. After getting the GC, let us apply for positions in DOL/USCIS and bring some positive process change internally.

I feel like giving up today after I saw a friend of mine leaving to india with a US Citizenship and an overseas citizen of india card.
The irony is he applied two months after me in the same category except his application was from a different state.
Now it makes me think, if I have to go through this process and after 5 years if I end up like my friend, then I might as well do it now...:confused:
Going back after US citizenship makes sense. He can come back when he wants and also get social security, medicare etc
But going back before that is defeat.

One thing that no one has pointed out and I wonder if people even care about it, but to me its a BIG issue.
All our hard earned $$$$ going into the Social Security and Medicare pool. Has anyone even thought about this ? If you look at your figure closely, it is the amount of money that an average american family saves over 1 year.
I personally feel that it is too big a contribution to let it to waste and for me getting a green card would make me eligible to get all the benefits that I deserve and have rightly earned.

My I140 is pending since 16 May 2007. My employer is not helping much. Employer is not giving his attorney contact number also. After calling millions of times they putted one service request 4 months back but nothing happend. I talked to few attonrnies they told they can only work if your employer signs G28 form for me. But my employer is not even picking my phone. Can I do any thing without my Employer's help?
