Guys,

I am at present on non-cap h1b and i have asked an employer to file for a new caped h1b in april 2008.

I have tentative plans of going to india in March end . In case i can't make it before april 1st back to US, can my new emplyer file for my New h1b while i am out side US...???

Is there any rule that, lates i-94 needs to be sent while aplying for h1b..???

greatly apppreciate any inputs....

I have a offer from an employer and they say that they will be able to provide documentation for GC processing but will not be able to sponsor. What does that mean? Can i hire attorney for my GC processing(EB2) and pay the expenses by myself? What else would be required from the employer?

Hi My wife's H4b status is valid till 6th sept. Now she has her h1b approved on 3rd july. Her employer states that the approved petition has some clause that she has to leave the country and come back with h1 on nov 1st. Both the employer and myself are not comfortable doing that.

Her employer suggesting for h1b renewal under premium process so that i might get receipt in few weeks and also says that he would reapply for H1 wiht the receipt for the approval.

Please suggest me the best possible way ...

I have approved I-140 (PD Sep,2007) but recently my H1 extension was denied so had to come on H4, so now what will happen to my GC, do I have to start from scratch OR my I-140 is still valid once I come back on H1 (with different employer).

However, since CIS sets aside up to 6,500 of this 65,000 for nationals of Chile and Singapore, it is possible that they will stop accepting other H-1B petitions soon, if not already. We are still filing new petitions, but with fingers crossed that they are not too late. If you need to file, please do so ASAP.

Currently I�m holding h1 and same time has AOS with my existing employer. I�m continuing my employment based on h1 and use Advance parole for travel purpose. My employer mentioned about not revoking I-140, even if I move to new employer. Since with new client, I�m transferring my H1 visa, I have 2 options with regard to my AOS portability

1) Either just transfers my h1 without porting AOS with new client. Continue with my AOS with old employer, since he won�t revoke my I-140 and provide support for future employment.

2) H1 transfer and Porting my AOS with new client and it does require my job and description mentioned in I-140 matches with current offer.

I would really appreciate, if you provide your valuable suggestion/recommendation. The best option to go ahead with.

Hi Friends,

I'm working with employer A and my PERM labor got certified with employer B. My second H1B duration ends Sep 2011 (12 months) and I can recapture 5 months.

1. Will I get 3 yrs of H1B extension if do the H1B transfer after my I-140 with employer B is approved.

2. Will I get 2 years of H1B extension (09/2011 + 1 yr with approved Labor) if I do H1B transfer now?

3. I went for a vacation and returned US just now. My employer A has generated pay stub only for a week and forgot to pay for the vacation. Is it Ok to submit partially paid last pay stub for the H1B transfer. FYI, I've all the other pay stubs for the previous months.

It'll really helpful to decide based on the folks replies. Thanks alot for the help.

Is it possible to upgrade a pending I-485 (EB3 I-140) with a newly approved EB2 I-140?
Is there any USCIS mandated procedure to do that?

I think it will be taken care automatically, ( since your A number on I 485 and new I 140 will be the same )
