I have one white I 94 which you get at the port of last entry and three H1 I 94 (one original H1 I 94, two extention I 94s). The latest I 94 goes till 2010. Should I surrender all four I 94s or just the expired ones or just the white one.

Currently on H1B 8th year extension which will expire on 25th June, 2009.
Labor PD: 9th August, 2004
Labor cleared: 11th September, 2007.
I-140 (approval pending) filed on 4th October, 2007. Received at USCIS on 5th October, 2007.
Can�t file for I-485 since the EB3 date for India is unavailable.
There is a high chance that I might be laid off at my current employer in the next 2-3 weeks.
Can I transfer my H-1 upto June 25th, 2009 (or later) as well as start a new PERM case in EB2 category?
In case of the above H-1 transfer, will the new H-1 be valid for 1 year from the filing or will it be upto 25th June, 2009?
What are my other options not to go out of status or leave the country?

I am in EB3 with Labor and I-140 approved, I-485 in process, and have EAD/AP. If I switch employers and take up a new role (different from the one GC application is based on), and not file AC21 (because that's not applicable when switching job roles), should I continue to stay mum hoping to not receive a RFE for EVL and get a GC by mail silently someday or request new employer to file a new EB2 perm and preserve the old (2002) priority date?
In case I go with the former, and end up receiving a RFE, can I explain my true status and go for the latter at that point? What are the chances that one will receive an RFE for Employment verification for a case that has been pending for 7 years, and I-485 pending for 3 years?
Any personal experiences and guidance will greatly help me. Thank you!

Hi,
I just want to know where is my "H1B Visa Extension Application" needs to apply by my employer.
Following are the details,
1. My Employer located in Virginia.
2. My current work location is Minnesota (and applying the H1extension with this Client's letter).
3. This is my second extension; i.e First H1b is for 2 years; and second H1b(i.e extension) for 3 years . all(5years) with the same employer.
4. I have approved I-140 also.
So 1) which will be the Service Center of mine to apply my H1B Extension
2) I heard Approved I-140 will be an advantage for a 3 year H1 extension application, but do this really matter if I have 3 months Purchase order or Contract with the client.
Please let me know.

My problem is
I am on valid L1 with company A and company B has applied for H1 for me. If my H1 gets approved
1. Can I continue to work on L1 with company A.
2. I want to go back to home country on vacation. If my H1 is approved can I go back to my home country and come back on L1?Do I need to get my L1 stamped again to enter back in US on L1? what will happen to my H1?
Please Advice.

Once we receive EAD and all 9 yards notices and once you switch from H1 to EAD system with same employer, are you still bound to work with same employer for full 40 hours.. can you cut your hours to 20 hours (nooo second job too). I can just work 20 hours a week . Is that permissible to be on EAD and still get GC processed?

hey everyone I was trying to download the swift 3d because a pparently it sweems like a cool one but the download trial wasn't accuriable anyway I looged into the net store and checked the full program, it costs about 159$ so I guess I want to download the trial first to give it a try before spending that much amount of money so if any of you know where to donwlaod it just plz post me a message with the title"FOund what you wanted" on your subjectt space.=)

Guys,
I submitted 485 application for me (primary) and my wife (secondary); now she is changing her job before we can get the receipt for 485 filing....she is on h1B....the new employer will file her H1B transfer..........does anyone see any issue with this????
I think its fine as her H1 status is independent of we filing 485....any thoughts?

I am waiting for the approval of my I-131. Can I fax a request to approve/speedup the process? If I can send the fax, can someone pass the fax number?
Background:
I applied for I-131 online in May, 2008 at TEXAS Service center. I applied before 120 days of the expiration. In December 2008 I got an RFE asking for the reasons why I applied before 120 days of expiration of AP authorization. I sent the response on Dec 11th.

I have I-140 approved and waiting for PD to become current. Wife , however, is from ROW country and i am looking to applying I-485 for both of us using Cross Chargeability.
Is Cross Chargeability guaranteed to work or do USCIS employees have a discretion if they approve it or not ?
After researching a lot it seems like lot of people have had a hard time in being successful in conveying their CC eligibility to USCIS. What is the difficulty in conveying CC eligibility to USCIS? It seems like people mentioned about their CC in a cover letter to their I-485 but USCIS would miss reading or understanding this information. What is the secret to successfully conveying CC eligibility to USCIS ?
